Terms of Service

Welcome to AGK Leads ("Platform", "Service", "we", "us", "our"). By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Service.

1. Acceptance of Terms

By creating an account, accessing, or using any part of this Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

We may update these Terms from time to time. We will notify registered users of material changes via email or in-platform notification. Continued use after changes constitutes acceptance.

2. Eligibility

  • You must be at least 18 years old to create an account or use this Service.
  • If you are using the Service on behalf of a business, you represent that you have authority to bind that organization to these Terms.
  • The Service is intended for business use (B2B SaaS). It is not directed at children under 18.

3. Account Registration & Security

  • You must provide accurate, complete, and current information during registration.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must immediately notify us of any unauthorized access to your account.
  • New client accounts require administrator approval before full access is granted.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Permitted Use

You may use the Platform solely for lawful business purposes related to event management, lead generation, art tool management, employee coordination, and related SaaS functionalities. You agree not to:

  • Use the Service for any unlawful, fraudulent, or malicious purpose.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or systems.
  • Reverse-engineer, decompile, or disassemble any part of the Software.
  • Distribute malware, spam, or unsolicited communications through the Platform.
  • Scrape, crawl, or use automated tools to extract data without authorization.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Sublicense, resell, or redistribute the Service without written consent.

5. Intellectual Property

All content, art tools, artwork, designs, trademarks, software, code, and proprietary concepts within the Platform are the intellectual property of AGK Leads and its creator, Mr. Ganesh Aruna Linganna Mukkera. All rights are reserved.

  • You may not copy, reproduce, modify, distribute, or create derivative works from our intellectual property.
  • Any artwork generated using our art tools remains subject to our licensing terms. You receive a limited license to use generated artwork for the event or purpose for which it was created.
  • User-uploaded content remains your property. By uploading, you grant us a limited license to store, process, and display it solely for Service functionality.

6. Data & Privacy

Your privacy is critically important to us. Please review our Privacy Policy for detailed information on how we collect, use, protect, and share your data.

  • We process personal data in compliance with applicable data protection laws including GDPR and India's Digital Personal Data Protection Act.
  • You retain ownership of your data. We act as a data processor for client/event data.
  • You can request data export or account deletion at any time through your privacy settings.

7. Billing & Payments

  • Billing terms (prepaid, postpaid, or hybrid) are set during account onboarding by the administrator.
  • Payment obligations are governed by the billing plan assigned to your company account.
  • All fees are in the currency specified in your billing agreement (default: INR).
  • Failure to pay may result in service suspension or account downgrade.
  • Refund eligibility is determined on a case-by-case basis. Contact our support team for disputes.

8. Service Availability & SLA

  • We strive for high availability but do not guarantee uninterrupted service.
  • Maintenance windows will be communicated in advance when possible.
  • Service Level Agreements (SLAs) apply as configured per account and are tracked within the platform.
  • We are not liable for outages caused by force majeure, third-party services, or user actions.

9. User Content & Conduct

You are solely responsible for all content, data, and materials you upload or transmit through the Service. You warrant that:

  • You have all necessary rights to the content you upload.
  • Your content does not infringe upon any third-party rights.
  • Your content does not contain illegal, harmful, defamatory, or objectionable material.

We reserve the right to remove content that violates these Terms without prior notice.

10. Third-Party Services

The Platform may integrate with third-party services (payment gateways, calendar sync, analytics). Your use of third-party services is governed by their respective terms. We are not responsible for third-party service availability, errors, or data practices.

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
  • We do not warrant that the Service will be error-free or uninterrupted.

12. Indemnification

You agree to indemnify, defend, and hold harmless AGK Leads, its creator, officers, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of the Service.

13. Termination

  • You may close your account at any time through your privacy settings or by contacting support.
  • We may suspend or terminate your account for violations of these Terms.
  • Upon termination, you may request export of your data within 30 days.
  • Provisions that by nature should survive termination will remain in effect (intellectual property, limitation of liability, indemnification).

14. Governing Law & Disputes

  • These Terms are governed by the laws of India.
  • Any disputes shall be resolved through arbitration or in the courts of Hyderabad, Telangana, India.
  • Before filing any claim, both parties agree to attempt resolution through good-faith negotiation for at least 30 days.
